Terms of Service

1. Acceptance of Terms

By accessing or using Mold Inspector Pro ("the Service"), operated by Mold Inspector Pro LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including inspectors, physicians, and any other individuals who access the platform.

2. Description of Service

Mold Inspector Pro is a professional software platform for mold inspection management, AI-assisted mold species identification, health assessment tools (including CIRS screening), report generation, and a physician portal for patient tracking. The Service is intended for licensed professionals and is not a substitute for professional medical advice, diagnosis, or treatment.

3. Eligibility and Account Registration

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Billing

The Service is offered on a subscription basis. A 14-day free trial is available to new users. After the trial period, continued use requires a paid subscription. Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Payments are processed by Stripe, Inc., and are subject to Stripe's terms of service.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Upload or transmit any content that is defamatory, obscene, or infringes on the rights of third parties
  • Attempt to gain unauthorized access to any part of the Service or its related systems
  • Use the Service to store or transmit protected health information (PHI) in a manner that violates HIPAA
  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Use automated tools to scrape, crawl, or extract data from the Service without written permission

6. Health and Medical Disclaimer

The AI-powered mold identification, CIRS screening tools, and health assessment features provided by the Service are for informational and professional workflow purposes only. They do not constitute medical advice and are not a substitute for the professional judgment of a licensed physician or healthcare provider. Results generated by the Service should be reviewed and validated by qualified professionals before being used in any clinical or legal context.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for ensuring that any personal or health information you upload to the Service is done in compliance with applicable privacy laws, including HIPAA where applicable.

8. Intellectual Property

All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, and AI models — are the exclusive property of the Company and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your internal business purposes.

9. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may cancel your subscription at any time through the Billing page. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
